Terms of Service

1. Who We Are
Itinly ("the App") is operated by Jenny Potts (sole trader), based in the United Kingdom. These Terms of Service govern your use of the App.
2. Acceptance of Terms
By creating an account or using the App, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use the App. You must be at least 16 years old to use the App.
3. Description of Service
Itinly is a travel planning application that allows you to create, manage, and share trip itineraries. Features include AI-powered itinerary generation, hotel and activity recommendations, collaborative trip planning, and trip export.
We are not a travel provider. Itinly does not provide travel, accommodation, or activity services. We are not a travel agency or tour operator. We act solely as a platform for planning and discovering travel information. Any bookings you make through third-party links are between you and that provider.
4. Account Responsibilities
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Providing accurate information when creating your account
- Notifying us immediately of any unauthorised use of your account
5. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose
- Attempt to gain unauthorised access to the App or its systems
- Interfere with or disrupt the App's infrastructure
- Upload malicious content or spam
- Scrape, crawl, or use automated means to access the App
- Impersonate another person or entity
6. Subscriptions and Payments
Itinly offers a free plan with usage limits and a Pro plan with unlimited access. Pro subscriptions are billed monthly or yearly through Apple's App Store or Google Play Store.
- Payment will be charged to your Apple ID or Google account at confirmation of purchase
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period
- Your account will be charged for renewal within 24 hours prior to the end of the current period
- You can manage and cancel your subscription at any time through your App Store or Google Play Store account settings
Refunds are subject to the refund policies of Apple or Google, as applicable.
7. Intellectual Property
The App, including its design, code, features, and branding, is owned by us and protected by intellectual property laws. You retain ownership of the trip content you create. By using the App, you grant us a limited licence to store and display your content as necessary to provide the service.
8. Third-Party Services
The App integrates with third-party services including OpenAI, Google Maps, Geoapify, Sentry, Pexels, Booking.com, GetYourGuide, and Viator. Your use of these services through the App is subject to their respective terms of service. We are not responsible for the content, accuracy, or availability of third-party services.
9. AI-Generated Content
Itinly uses artificial intelligence to generate and edit trip itineraries. AI-generated content is provided for informational purposes only and may be incomplete or inaccurate. You are responsible for verifying all travel details, including availability, pricing, safety, and legal requirements, before making decisions. We are not responsible for any losses arising from reliance on AI-generated content.
10. Service Availability
We do not guarantee that the App will always be available, uninterrupted, or error-free. We may modify, suspend, or discontinue any part of the App at any time. We may update, change, or remove features of the App without prior notice.
11. Limitation of Liability
To the maximum extent permitted by law, the App is provided "as is" without warranties of any kind, whether express or implied. We are not liable for:
- Accuracy of hotel recommendations, activity suggestions, or travel information
- Any losses arising from reliance on information provided by the App
- Service interruptions or data loss
- Actions of third-party services integrated with the App
- Any indirect, incidental, or consequential damages
To the maximum extent permitted by law, our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim.
Nothing in these Terms excludes or limits liability where it cannot be excluded or limited under applicable law (including liability for death or personal injury caused by negligence, or for fraud).
12. Termination
We may suspend or terminate your account if you violate these terms. Upon termination, your right to use the App ceases immediately. You may delete your account at any time through Profile > Delete Account. We will delete or anonymise your data in accordance with our Privacy Policy.
13. Force Majeure
We are not responsible for any delay or failure to perform our obligations caused by events beyond our reasonable control, including but not limited to natural disasters, internet outages, or third-party service failures.
14. Changes to Terms
We may update these Terms of Service from time to time. Continued use of the App after changes constitutes acceptance of the updated terms. We will notify you of significant changes through the App.
15. Governing Law
These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
